12 Days of Holiday Cheer Giveaway (THE “Giveaway” or “Sweepstakes”) IS ONLY OPEN TO LEGAL RESIDENTS OF THE U.S. THROUGHOUT THE GIVEAWAY PERIOD AND WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT TIME OF ENTRY. GIVEAWAY SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. THE GIVEAWAY STARTS 12.26.2023 12 p.m. CST AND ENDS 01.06.2024 12 am CST (THE “GIVEAWAY”); HOWEVER, SPONSOR RESERVES THE RIGHT TO END THE GIVEAWAY AT ANY TIME. VOID WHERE PROHIBITED. SPONSOR:

The Giveaway is sponsored by Home Run Inn Inc., 1300 Internationale Pkwy Woodridge, IL 60517 (the “Sponsor” or “Home Run Inn”).

CONDUCT:

This Giveaway is governed by these official rules (“Official Rules”). By entering this Giveaway, entrants agree to be bound by these Official Rules and the decisions of the Sponsor shall be final and binding in all respects. The Official Rules will be posted on the following website throughout the Giveaway Periodhttps://www.homeruninnpizza.com/promotion/12-days-of-holiday-cheer/ Failure to comply with these Official Rules may result in disqualification. The Sponsor reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Giveaway or the website; or to be acting in any manner deemed by the Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by the Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.

ELIGIBILITY:

NO PURCHASE NECESSARY TO ENTER THE GIVEAWAY OR WIN PRIZE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. To enter the Giveaway, entrants: (i) must be 18 years of age or older at the time of entry (ii) must be a legal resident of the United States (iii) must not be considered a minor or legally incompetent in your state of residence. *The Giveaway is void in New York, Florida, Puerto Rico, U.S. territories and possessions, and where otherwise restricted or prohibited by law.* The Giveaway is subject to all applicable federal, state and local laws and regulations. Employees, officers and directors of Sponsor, their respective parents, subsidiaries, licensees, agencies and affiliates or those of any other company involved with the design, production, execution or distribution of this Giveaway are not eligible to participate in the Giveaway or to win any prizes. Any Giveaway entries received from an ineligible participant will be disqualified.

GIVEAWAY PERIOD:

The Sponsor reserves the right to extend or shorten the giveaway in its sole discretion.

HOW TO ENTER:

Follow @HomeRunInn on Instagram: Eligible participants must follow Home Run Inn’s official Instagram account (@HomeRunInn) on Instagram.
Tag a Friend: Eligible participants are instructed to tag two (2) additional “friends” (accounts) in the comments section of the official giveaway post(s) on @HomeRunInn’s Instagram account (see @HomeRunInn’s Instagram page for official giveaway post).
[You may enter only once per day. You may return to @homeruninn to enter again; however, no more than [one entry per day per person[, household,] Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not circumvent the rules.

Entrant agrees that the Sponsor may use or disclose his or her entry in whole or in part, commercially or non-commercially, in any media, in perpetuity, worldwide, including the right to publish and display the entry for advertising and publicity, and to edit and make derivative works, all without additional notification, review, approval or compensation to anyone, including entrant. Additionally, entrant agrees that Home Run Inn may post the entry (including your name), or any portion thereof, on the Website and/or its webpages on third-party sites, and/or use in any media.

All entrants consent to Sponsor’s right to contact the entrant after entrant’s entry into the Giveaway for purposes of Prize notification or other correspondence relating to the Giveaway. The Sponsor may contact an entrant by means of any correspondence or communication, including emailing, telephone calls, or text messages.

DRAWING:

A random drawing will be conducted every day from 12.26.2023 – 01.06.2024 by Sponsor to select the winners from among all eligible entries received. All winners will be announced on January 7, 2021. Odds of winning depend on the number of entries received. Potential winners will be notified by email, message or post and must sign and return any required Affidavit of Eligibility and Release within 7 days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this Sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes permission to the Sponsor and/or Promotion Parties to use winner’s name and likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

LIMITATION OF LIABILITY:

By entering this Sweepstakes, entrants waive all right to, and hold the Sponsor and any their affiliates, subsidiaries, and agencies (collectively “Promotion Parties”) harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right to request that the Sponsor, in its sole discretion, cancel or modify this Sweepstakes in a manner deemed appropriate by the Sponsor. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.

Prizes are nontransferable, nonnegotiable and non-divisible unless otherwise stated in writing or agreed to in writing by the Sponsor.

Winners’ personal information related to Giveaway entry, including, but not limited to, first and last names, full mailing address, phone number, and/or email address, may be shared with other companies involved with the design, production, execution or distribution of this Giveaway for the purpose of Prize awarding and delivery. The winner must provide the mailing address where they would like the prize(s) to be shipped, and/or provide information regarding picking up the prizes in-person. If winners are unable to respond within a calendar week (7 days) of the winner’s announcement or provide reasonable information regarding facilitating the delivery of the prizes, another winner may be selected.

All prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by the Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Giveaway and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any prizes being offered, except that the prizes shall be subject to its manufacturer’s standard warranty (if any).

The odds of winning depend on the number of eligible entries received.

PRIZE WINNER NOTIFICATION:

The potential winners will be notified via a tagged (tagged winner’s Instagram account/handle) post on @HomeRunInn’s Instagram stories. Home Run Inn will reach out directly via Instagram to facilitate delivery of the Giveaway prize(s).

If a winner fails to comply with these Official Rules, that winner will be disqualified. ALL FEDERAL, STATE, LOCAL, AND INCOME TAXES ON PRIZES AND EXPENSES RELATING TO ACCEPTANCE AND USE OF PRIZES NOT SPECIFIED ARE THE SOLE RESPONSIBILITY OF THE WINNER.

ADDITIONAL LIMITATIONS:

If for any reason this Giveaway is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway, at which time, the Sponsor will conduct a random drawing from among all eligible entries received at the time of the Giveaway termination. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions or any telephone network or telephone lines, computer on‑line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway.

PUBLICITY:

Except where prohibited by law, entry into the Giveaway and acceptance of Prize constitute permission to use winner’s name, Prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion, and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Except as expressly stated in these Official Rules, no substitution, cash redemption or transfer of the Prize is allowed, but the Sponsor reserves the right to substitute for the advertised Prize a prize of equal or greater value if the advertised Prize becomes unavailable for any reason.

CHOICE OF LAW AND VENUE:

Except where prohibited, the entrant agrees that any disputes, claims and causes of action arising out of, or connected with, the Giveaway or any Prize awarded, or the determination of the winner, shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights, and obligations, or the rights and obligations of the Sponsor or the Giveaway Entities in connection with the Giveaway shall be governed by, and construed in accordance with, the laws of the *State of Illinois*, without regard for conflicts of law doctrine, and all proceedings shall take place in La Crosse County, State of Wisconsin.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THE GIVEAWAY WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
