OFFICIAL RULES 

By entering into the Home Run Inn Free Pizza For A Year (“Sweepstakes), participant (“Participant“) agrees to abide by these Official Sweepstakes Rules and Legal Disclaimer (the “Official Rules”) and the decisions of Home Run Inn Inc., (“Sponsor”), which are final and binding in all respects. 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. PARTICIPATION IN THE SWEEPSTAKES REQUIRES ACCEPTANCE OF THESE OFFICIAL RULES, WHICH INCLUDE A CLASS ACTION WAIVER. IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, YOU MUST NOT PARTICIPATE IN THE SWEEPSTAKES. 

• ELIGIBILITY: Open to legal residents of the United States (excludes NY and RI) ages 18+ or the age of majority in their state (19+ AL/NE; 21+ MS). Residents from New York, Rhode Island, Puerto Rico, Guam, the US Virgin Islands, and other United States territories and possessions are not eligible to enter the Sweepstakes or win a Prize. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Participation in the Sweepstakes requires access to the internet. Internet access, phone, and usage charges imposed by your online or mobile service provider may apply. Employees of Sponsor, their affiliates, subsidiaries, and agencies (collectively “Promotion Parties”), and members of their immediate family or persons living in the same household are not eligible to enter the Sweepstakes or win a Prize. 

• HOW TO ENTER: No Purchase Necessary. No purchase or payment of any kind is necessary to enter or win. A purchase will not increase your chances of winning. You must be an existing subscriber in the Home Run Inn email database during the entry period. Limit one (1) entry per person/email address. 

• RANDOM DRAWING:  On or about each drawing date indicated in the chart above in Section 1, Administrator will select one (1) potential winner from the Home Run Inn MVP Database.  Each winner is deemed to be a potential winner, pending verification of the entrant’s eligibility and compliance with these Official Rules as determined by Sponsor or Administrator, at their sole and absolute discretion.  

• PRIZES, APPROXIMATE RETAIL VALUE (“ARV”), AND ODDS OF WINNING: 

1. Prizes (12 total; 1 per Entry Period from the Illinois Pool of Home Run Inn MVP Club entrants):  Each prize is Home Run Inn pizza for one (1) year awarded as 12 ($20) Home Run Inn Gift Cards (up to a value of $20 each card and one $240 gift card will be given) (each a “Prize”) will be delivered monthly via email to the entrant’s primary email address OR 12 (twelve inch frozen pizza coupon) frozen pizza coupons that will be mailed directly to the winner, in which a address must be supplied to Home Run Inn by the winner. Email address may not change during the course of the year.  Home Run Inn Gift Cards can be redeemed at any participating Home Run Inn Restaurant excluding Home Run Inn Midway Airport locations, OHARE Airport locations or Home Run Inn Wrigley Field stands. Terms and conditions of Home Run Inn Cards apply. The ARV of each Prize is $240 USD.  No more than twelves (12) total Prizes will be awarded in the Promotion.  
2. Total ARV:  The total ARV of all Prizes available in this Promotion is $2,880 USD. 
3. Odds of Winning:  The odds of winning a Prize depend on the number of eligible entries received for Pool during each Entry Period of the Promotion Period.  
4. General: There is a limit of one (1) Prize per person. In no event will more (12) Prizes, be awarded. If, for any reason, more Prize notifications are sent (or more claims are received) than the number of Prizes offered, as set forth in these Official Rules, Sponsor reserves the right to award the intended number of Prizes through a random drawing from among all eligible Prize claims received. 

HOW TO CLAIM A PRIZE:  Each potential winner will be notified via e-mail by Sponsor or its authorized designee at the e-mail address provided at the time of entry. Before being declared a winner, each potential winner will be required to execute an Affidavit of Eligibility/Liability & Publicity Release and tax acknowledgment (“Affidavit”), a US resident, or a Declaration of Eligibility/Liability/Publicity Release. The potential winner must return a fully executed and notarized Affidavit/Declaration to the Sponsor or its authorized designee within seven (7)) calendar days from the date it is postmarked as being sent to the potential winner or the Prize may (in Sponsor’s sole discretion) be forfeited. If the potential winner is younger than twenty-one (21) years of age or a minor under the law of his/her jurisdiction of residence at the time of entry, his or her respective parent or guardian may be required to execute an Affidavit/Declaration acknowledging, confirming and consenting to the Release document in order to accept the Prize on behalf of the winner. If parent or guardian is unavailable to execute this document, the winner will not receive the Prize. Failure to reply to any e-mail notification, complete and return the documents in the time noted or if prize notification is undeliverable will result in disqualification. If a potential winner is disqualified, found to be ineligible or not in compliance with these Official Rules, declines to accept the Prize, or in the event that a potential winner fails to return an executed and notarized Affidavit/Declaration, or fails to correctly complete the skill-testing question, within the seven (7) calendar day deadline, the Prize may be forfeited, and in the Sponsor’s sole discretion, the forfeited Prize may be awarded to an alternate winner, selected in a random drawing from among all remaining eligible entries, as determined by Sponsor in its sole discretion. If, after a good-faith attempt, Sponsor is unable to award or deliver a Prize, the Prize may not be re-awarded. The Winners shall bear all risk of loss or damage to their prize after it has been delivered. Sponsor will not replace prize that is lost, stolen, or misdirected. The prize will be awarded “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. 

• ALL FEDERAL, STATE, PROVINCIAL, TERRITORIAL, AND LOCAL TAXES IMPOSED ON THE ACCEPTANCE OF THE PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNERS.  

• Sponsor will attempt to notify each potential winner as set forth above, but Sponsor is not responsible for any undelivered emails, including without limitation e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Promotion e-mail, including any winner notification e-mail, to a spam or junk folder. The right to receive a Prize is non-assignable, non-transferable and no Prize substitution or exchange will be allowed, except by Sponsor, who reserves the right to substitute a Prize of equal or greater value in case of unavailability of a Prize or force majeure, at Sponsor’s sole and absolute discretion. All other costs and expenses not expressly set forth herein shall be solely the winner’s responsibility. Sponsor will attempt to mail the Prizes approximately 6 – 8 weeks from verification of winner’s eligibility. Promotion Entities shall not be held responsible for any delays in awarding a Prize for any reason. 

• WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

• LIMITATION OF LIABILITY. IN NO EVENT WILL SPONSOR, PROMOTION PARTIES, INSTAGRAM, AND/OR SPONSOR’S PARENT, SUBSIDIARY, LICENSEES, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, ASSIGNS, AFFILIATES, OR RELATED COMPANIES (COLLECTIVELY WITH SPONSOR, THE “SPONSOR PARTIES“), BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS) ARISING OUT OF: (I) ANY PARTICIPANT’S PARTICIPATION IN THE SWEEPSTAKES; (II) THESE OFFICIAL RULES; (III) ANY PARTICIPANT’S RECEIPT, USE, OR MISUSE OF A PRIZE; (IV) OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY NO MATTER UNDER WHAT THEORY ARISING, EVEN IF ANY SPONSOR PARTY HAS BEEN ADVISED OF THE POSSIBLY OF SUCH DAMAGES. EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING SPONSOR’S INSTAGRAM PAGE AND ALL PRIZES, ARE PROVIDED “AS-IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SPONSOR PARTIES’ ENTIRE LIABILITY WITH RESPECT TO: ANY PARTICIPANT’S PARTICIPATION IN THE SWEEPSTAKES, THESE OFFICIAL RULES, AND/OR ANY PARTICIPANT’S RECEIPT OF A PRIZE SHALL BE LIMITED TO OUT OF POCKET EXPENSES INCURRED, IF ANY, IN ENTERING THE SWEEPSTAKES. SOME JURISDICTIONS MAY NOT ALLOW THE AFOREMENTIONED LIMITATIONS OR EXCLUSIONS OF LIABILITY AND AS SUCH, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. 

• RELEASE. Subject to applicable law, by entering into the Sweepstakes and/or receiving a prize, each Participant agrees to release, discharge, and hold harmless Sponsor and Sponsor Parties from and against any claim, cause of action, demand, or proceeding (each, a “Claim“), and any resultant loss, injury (including death), cost, expense, fee, fine, penalty, or other loss or expense of any kind, including attorneys’ fees (each, a “Loss“), relating to or arising directly or indirectly out of his or her participation in the Sweepstakes (or Sweepstakes-related activity such as a press release), and/or Sponsor’s right to exploit Winner’s name and/or likeness or fully exploit any other right granted to it hereunder, and/or from Winner’s receipt, use, or misuse of any Prize, no matter how such Claim or Loss arises (including without limitation, if arising out of any damage to a Participant’s computer system from downloading or using material from Sponsor’s Website, or an affiliate of Sponsor’s, website) including but not limited to (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable e-mail/text notifications or postal mail; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information; (vi) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes; (vii) any injury or damage, whether personal or property, to Participant or to any person’s computer related to or resulting from participating in the Sweepstakes and/or accepting a Prize; and (viii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Sweepstakes. 

• PUBLICITY. Subject to applicable law, entrance in the Sweepstakes constitutes Winner’s consent to Sponsor, the Promotion Parties, and Sponsor’s or Promotion Parties’ affiliates and agents (which grant shall be confirmed in writing on request) to use his or her name, voice, likeness, opinions, and biographical information for marketing, advertising, and publicity purposes in any media throughout the world at any time without the obligation to seek consent or to provide Winner with any payment or other form of consideration, Winner hereby releases Sponsor, the Promotion Parties’ and their designees from any liability with respect to such use. Winner agrees to execute any document reasonably required by Sponsor to effectuate the terms hereof. 

• CHOICE OF LAW AND FORUM; CLASS ACTION WAIVER: This Sweepstakes is governed by the laws of the State of Illinois, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, Participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Chicago, Illinois, USA having jurisdiction. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and Participant further waives all rights to have damages multiplied or increased. 

• GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, cyberattacks, computer viruses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Sweepstakes, including but not limited to entry method and/or fulfillment of the prize(s), as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to modify the prizes offered herein and to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of any conflict with any details contained in these Official Rules and the details contained in any Sweepstakes promotional materials (including, but not limited to, point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail. In the event there is a discrepancy or inconsistency between disclosures, any printed versions of these Official Rules, or any other statements contained in any Sweepstakes-related materials and the Official Rules as posted on the Website, the Official Rules as posted on the Website shall prevail, govern and control. All federal, state, and local laws apply.
